Terms of Service for XYCrat

1. Acceptance of Terms

By installing and using the XYCrat Google Workspace Add-on ("the Add-on"), you agree to be bound by these Terms of Service. This is a legally binding agreement between you ("User") and AimanRemy Labs ("we", "our", or "us"). If you do not agree to these terms in their entirety, do not install or use the Add-on.

2. Description of Service

XYCrat is an automation tool that merges data from Google Sheets into Google Docs/Slides and generates PDFs or emails via Gmail.

THE ADD-ON IS PROVIDED "AS-IS" AND "AS-AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. AIMANREMY LABS DOES NOT WARRANT THAT THE ADD-ON WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR COMPATIBLE WITH ALL GOOGLE WORKSPACE CONFIGURATIONS, AND EXPRESSLY DISCLAIMS ANY LIABILITY FOR SERVICE INTERRUPTIONS, BUGS, OR FUNCTIONALITY CHANGES RESULTING FROM UPDATES TO GOOGLE APIS OR GOOGLE WORKSPACE.

3. User Responsibilities & Compliance

You are solely responsible for all content generated, transmitted, and distributed using XYCrat. You acknowledge and agree that:

  • You must comply with all applicable local, national, and international laws and regulations, including but not limited to the General Data Protection Regulation (GDPR), the CAN-SPAM Act, the Singapore Personal Data Protection Act (PDPA), and Google's Acceptable Use Policy.
  • You must not use XYCrat to send unsolicited commercial communications (spam), bulk unsolicited emails, phishing emails, fraudulent content, or any form of malicious, harassing, or deceptive content.
  • You are responsible for obtaining all necessary consents, permissions, and lawful bases for processing personal data of your email recipients and document subjects.
  • AimanRemy Labs maintains a strict zero-tolerance policy against spam and reserves the unconditional right to report violators to Google, terminate access, and cooperate fully with law enforcement authorities.

4. Indemnification

You agree to indemnify, defend, and hold harmless AimanRemy Labs, its affiliates, officers, directors, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal and professional fees) arising out of or in connection with:

  • Your use or misuse of the XYCrat Add-on;
  • Any content you generate, transmit, store, or distribute through the Add-on;
  • Your violation of any applicable laws, regulations, or third-party rights, including intellectual property rights, privacy rights, and data protection laws;
  • Your breach of these Terms of Service or Google's Terms of Service.

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIMANREMY LABS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (a) THE USE OR INABILITY TO USE THE XYCrat ADD-ON; (b) GOOGLE API QUOTA LIMITATIONS, RATE LIMITING, SERVICE SUSPENSIONS, OR ACCOUNT RESTRICTIONS IMPOSED BY GOOGLE; (c) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (d) STATEMENTS OR CONDUCT OF ANY THIRD PARTY; OR (e) ANY OTHER MATTER RELATING TO THE ADD-ON.

IN NO EVENT SHALL AIMANREMY LABS' TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR THE USE OF THE XYCrat ADD-ON. IF YOU HAVE NOT PAID ANY FEES, AIMANREMY LABS' LIABILITY SHALL BE LIMITED TO THE MINIMUM AMOUNT PERMITTED BY APPLICABLE LAW.

6. Modifications to the Add-on and Terms

We reserve the right to modify, suspend, or discontinue the XYCrat Add-on (or any part thereof) at any time without notice. We also reserve the right to update these Terms of Service at our discretion. Continued use of the Add-on after any changes constitutes acceptance of the revised terms.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
